These Terms & Conditions ("Terms") govern your use of beBIONIC's websites, intake forms, and services (the "Services"). By using the Services, submitting an intake, or making a payment, you agree to these Terms. If you do not agree, do not use the Services.
1. What we are (and aren't)
beBIONIC facilitates access to a physician-supervised care team of licensed providers who independently evaluate whether treatment is appropriate for you. beBIONIC is not a pharmacy and does not manufacture, compound, dispense, or ship medications. Nothing on our websites or advertising is medical advice; only your provider can give you medical advice.
2. Eligibility & honest information
- You must be 18 or older and located in a state we serve.
- You agree that everything you submit — including your medical history, medications, and allergies — is truthful, accurate, and complete. Providing false or incomplete health information is dangerous, is a material breach of these Terms, and releases beBIONIC and its providers from liability for outcomes caused by that false or incomplete information.
- Submitting an intake does not create a provider-patient relationship and does not guarantee a prescription. Not all applicants qualify. A licensed provider makes all treatment decisions.
3. Payment, holds & refunds
- When you submit an intake requiring payment, we place an authorization hold on your card. You are charged only if a licensed provider approves your plan; if you are not approved, the hold is released in full.
- Once a provider has reviewed your case and a prescription has been sent to a pharmacy, fees for that review and fulfillment cycle are non-refundable.
- Prescription medications cannot be restocked or resold once dispensed. Dispensed and shipped medications are non-refundable, except as required by law.
4. Independent pharmacies — dispensing & compounding
Prescriptions are filled by independent, state-licensed pharmacies that are not owned or controlled by beBIONIC. The dispensing pharmacy is solely responsible for the compounding, preparation, labeling, packaging, and accuracy of your medication. To the fullest extent permitted by law, beBIONIC is not liable for pharmacy errors, including dispensing errors, compounding defects, mislabeling, or delays at the pharmacy. If you believe there is a problem with your medication, do not use it — contact us at (813) 563-2799 and we will help you coordinate with the pharmacy for review and, where appropriate, replacement.
5. Shipping & delivery
Medications ship from the pharmacy via third-party carriers (e.g., FedEx, UPS, USPS). Risk of loss passes to the carrier upon shipment. To the fullest extent permitted by law, beBIONIC is not responsible for carrier delays, lost or stolen packages, misdelivery, weather events, or temperature excursions occurring after the package leaves the pharmacy. You are responsible for providing an accurate shipping address and for promptly retrieving delivered packages (many medications are temperature-sensitive). Report a lost, damaged, or missing shipment to us within 48 hours of the expected delivery date and we will work with the pharmacy and carrier in good faith to resolve it, which may include a replacement shipment where appropriate.
6. Not for emergencies
The Services are not for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room.
7. Reviews & public statements
We welcome your honest feedback, including honest negative reviews — nothing in these Terms prohibits or penalizes truthful reviews of your experience. However, knowingly false, fabricated, misleading, or defamatory statements about beBIONIC, its staff, or its providers — in reviews, social media, or elsewhere — are not protected speech. beBIONIC reserves the right to pursue all available legal remedies for defamation, trade libel, and related claims, including damages and, where permitted by law, attorneys' fees. 8. Acceptable use
You agree not to misuse the Services, including: submitting intakes on behalf of another person without authority; attempting to obtain medication for someone else; reselling or distributing medication; scraping, probing, or interfering with our systems; or using the Services to violate any law.
9. Disclaimer of warranties
The Services are provided "as is" and "as available." To the fullest extent permitted by law, beBIONIC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Individual results vary; no outcome is guaranteed.
10. Limitation of liability
To the fullest extent permitted by law: (a) beBIONIC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill; and (b) beBIONIC's total aggregate liability arising out of or relating to the Services will not exceed the amounts you paid to beBIONIC in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless beBIONIC and its owners, officers, employees, and contractors from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your provision of false or incomplete information.
12. Dispute resolution — arbitration & class-action waiver
Please read this section carefully — it affects your legal rights.
- Informal resolution first. Before filing any claim, you agree to contact us at (813) 563-2799 or in writing and give us 30 days to resolve the dispute informally.
- Binding arbitration. Any dispute arising out of or relating to the Services or these Terms that is not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Hillsborough County, Florida (or conducted remotely by agreement). Judgment on the award may be entered in any court of competent jurisdiction.
- Class-action waiver. Disputes will be arbitrated on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.
- Exceptions. Either party may bring an individual claim in small-claims court, and beBIONIC may seek injunctive relief in court for misuse of its intellectual property or systems, or for defamation as described in Section 7.
- Opt-out. You may opt out of arbitration by written notice to beBIONIC within 30 days of first accepting these Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Subject to Section 12, exclusive venue lies in the state and federal courts located in Hillsborough County, Florida.
14. Intellectual property
The beBIONIC name, logo, websites, and content are owned by beBIONIC or its licensors and may not be copied or used without written permission.
15. Changes; severability; entire agreement
We may update these Terms from time to time; the effective date above reflects the latest version, and continued use of the Services constitutes acceptance. If any provision is found unenforceable, the remainder stays in effect. These Terms, together with our Privacy Policy, Notice of Privacy Practices, Telehealth Informed Consent, and SMS Terms, are the entire agreement between you and beBIONIC regarding the Services.
